The website www.hdcentre.org is operated by CENTRE HENRY DUNANT POUR LE DIALOGUE HUMANITAIRE (HD Centre for Humanitarian Dialogue), a Swiss foundation with registration number CHE-105.181.636, having its principal office at rue de Lausanne 114, 1202 Geneva, Switzerland and operating with local offices worldwide (“HD”).  Any questions or comments please contact pr@hdcentre.org.

By accessing the website you confirm that you accept and consent to these Terms and HD’s Privacy Policy (below).

HD may modify these Terms or the Privacy Policy at any time. Please check for updates whenever you access the website. These Terms were most recently updated in August 2022.

What can you do with website content?

Our website is published to provide information publicly. HD owns or has licence rights to use all intellectual property on the website and the domain name. Our rights are protected by law whether registered or not. 

If you wish to reproduce or otherwise refer to information in the website, you must include an acknowledgement of HD as the source (such as including the URL and a reference to HD and the date you retrieved the information) and ensure that any third-party intellectual property rights mentioned on the website are also respected and acknowledged in reproductions. 

Where some third-party materials are labelled as subject to copyright and not authorised for further reproduction, you must respect these terms. Information must not be redistributed in a manner that distorts or misrepresents the source.

Information must not be used for commercial purposes without HD’s prior written consent. Applications for commercial use and any questions should be addressed to pr@hdcentre.org.

Under no circumstances, including, but not limited to, negligence, shall HD or its affiliates be liable for any direct, indirect, incidental, special or consequential damages, even if HD has been advised of the possibility of such damages. 

The views and opinions expressed in any referenced documents or reference materials posted on the website do not necessarily state or reflect those of HD.

The mention of specific companies or other organisations or products does not imply they are endorsed or recommended by HD in preference to others of a similar nature that are not mentioned.

You may create links to the website provided you do so in a way that indicates the link is to the website and is fair and not misleading and does not damage HD’s reputation or take advantage of it.  

You may not integrate or make use of all or part of the website in ways that would confuse or mislead other internet users as to the nature and origin of the website content. 

HD reserves the right to request that you remove a link to the website if HD considers the link inappropriate or otherwise linking HD to sources that do not align with HD’s mandate. 

You must not establish a link in such a way as to suggest any form of association, approval or endorsement on HD’s part where none exists. HD suppliers may not link to the website without the prior written approval of HD. The website must not be framed on any other website. 

Viruses

HD cannot guarantee the website will be secure or free from bugs or viruses. You must use your own virus protection software.

You must not misuse the website by knowingly introducing viruses, trojans, worms, logic bombs or other material that is malicious or technologically harmful.

You must not attempt to gain unauthorised access to the website, the server on which the site is stored or any server, computer or database connected to the website.

You must not attack the website via a denial-of-service attack or a distributed denial-of service attack.

HD will report any such breach to the relevant law enforcement authorities and shall cooperate with those authorities by disclosing your identity to them. In the event of such a breach, your right to use our sites will cease immediately.

Indemnification

You agree that you will not use the website for any unlawful purpose or for any purpose prohibited by these Terms.

You agree to indemnify, defend and hold harmless HD and its related entities using the HD name and their board members, directors, employees, consultants, agents and subcontractors from any and all claims, liabilities, judgments, costs, penalties or other demands of any kind, or the settlement or avoidance thereof, made by any third party, together with all reasonable fees and expenses associated therewith, (together the “Claims”) arising out of or relating to (i) your violation of these Terms of Use, and/or (ii) your use or misuse of the website or materials therein.

Without in any way limiting the generality of the foregoing, this provision includes any claims relating to the use or misuse of third-party intellectual property.

Cookies

HD uses cookies to enhance the operation of the website. Cookies are small text files stored on your device when you visit a website. Cookies will store certain preferences that help with the operation of the website.

The HD website only stores cookies required for (i) proper functioning of the website (“Necessary Cookies”), (ii) recognising when you return to the website (“Functional Cookies”) and (iii) collecting anonymised statistics on website use (“Performance and Analytical Cookies”).

The Performance and Analytical Cookies collect information (including IP addresses) about how visitors use the site (pages visited, location of visitor, language) which is used to improve how the website works.

This site uses Google Analytics, which tracks among other things which pages you visit and how long you spend on each page.

Miscellaneous

HD’s failure to insist upon strict enforcement of any provision of these Terms shall not be construed as a waiver of any provision or right.

Use of this website is governed by Swiss law without regard to its rules of conflicts of laws. The courts of the canton of Geneva, Switzerland shall have exclusive jurisdiction.


Privacy Policy

Your privacy when using this website is of utmost importance to HD. This policy may change from time to time and updates will be posted here.

This Policy does not apply to third-party links on the website, which are governed by their own terms.

What personal data does HD collect?

HD may obtain personal data from you either directly from data you give HD or as a result of your use of the website or participation in social media accounts maintained by HD. This may include your name, telephone, address, email address, photos of you, date of birth and other personal data (“Personal Data”).

Information HD collects about you that potentially contains personal data also includes technical data including the Internet Protocol (IP) address used to connect your computer or mobile device to the Internet, online identifiers, your login information (if applicable), browser type and version, time zone setting, browser plug-in types and versions, operating system and platform; and information about your visit, including the full Uniform Resource Locators (URL), clickstream to, through and from the website (including date and time).

When you authorise a social media platform to share personal data with HD, HD may receive any personal data you share publicly on that platform — including your name, email address, gender, profile image, list of friends or contacts, preferences etc.  You should always be aware of the terms and conditions, as well as the privacy policy, of such social media that may be different to HD Terms and policies.

What HD does with your personal information

HD uses information held about you to:

  • Carry out any obligations from any contracts you entered into with HD or provide you with information and services that you have requested;
  • Provide access to such services and interactive features on the website or your requests for information updates that you have subscribed to and to notify you of any changes;
  • Administer the website and for internal analytical and technical purposes, including troubleshooting, data analysis, testing, research, statistical and survey purposes;
  • Contact you;
  • Improve the website and to ensure that content is presented in the most effective manner for you and for your computer and others; and
  • Use efforts to keep the website safe and secure.

HD will only solicit and use information that it receives about you from third parties for the purposes listed above.

How HD shares your personal data

You agree that HD has the right to share your personal information with:

  • Any HD offices or trusted HD partners and consultants on a worldwide basis to the extent that they need to have access to your personal data for the purposes set out in the above section;
  • Suppliers and service providers to the extent necessary for legitimate HD business purposes and provided that HD has put in place adequate agreements to protect your data;
  • Analytics and search engine providers that assist HD in the improvement and optimisation of the website; and
  • Providers of customer relationship management and e-mail distribution services.

HD will only otherwise disclose your personal information to other third parties if HD is under a duty to disclose or share your personal data to comply with any legal obligation, or to enforce or apply HD Terms or to protect the property, rights or safety of HD, licensors or others.

How and where HD stores your personal data

The data that HD collects from you may be transferred to, and stored at, a destination outside of Switzerland and the European Economic Area (”EEA”). It may also be processed by staff operating outside of Switzerland and the EEA who work for HD or for one of HD’s suppliers. This includes staff engaged in, among other things, the processing of any payment details and the provision of support services.

All information you provide is stored on HD secure servers or secure servers managed on HD’s behalf (including but not limited to the Microsoft Swiss Cloud).

HD is committed to ensuring a high level of data protection. Unfortunately, the transmission of information via the internet is not completely secure. HD has put in place appropriate technical and organisational measures in order to prevent unauthorised access and to ensure a sufficiently high level of security in relation to the inherent risk involved in data processing, to meet regulatory demands and to protect your rights and your data from the moment your data is collected.

By submitting your personal data, you agree to this transfer, storing, or processing. HD shall take all steps reasonably necessary to ensure that your data is treated securely and in accordance with applicable laws.

Information from children

HD does not seek to collect information from minors. Any person who is below the legal age in their country must obtain the authority of their legal representative before submitting their personal data to HD.

Your rights

You have the right to ask for the access to, amendment or deletion of your personal information at any time. You also have the right to ask HD not to process your personal data for communications purposes.

If you feel that HD has not appropriately handled the matter, you also have the right to refer the matter to the Federal Data Protection and Information Commissioner (FDPIC) of Switzerland.
